These Terms of Service (“Terms”) govern your access to and use of the Facoles website, products, and services (“Services”). By visiting our site or placing an order, you agree to be bound by these Terms as well as our Shipping Policy, Return & Refund Policy, Cancellation Policy, and Privacy Policy. If you do not agree, please do not use our Services.

Facoles may update or modify these Terms from time to time. Any changes take effect when the revised Terms are posted on this page. Your continued use of the site after changes are posted means you accept the updated Terms. We recommend reviewing this page periodically.

1. Fraud Prevention & Security

To protect our customers and business, Facoles actively screens orders for signs of fraud, unauthorized use, or illegal activity. We reserve the right to:

• Refuse or cancel any order that appears suspicious, violates these Terms, or fails payment authorization.
• Limit or block orders to certain accounts, payment methods, or shipping addresses if fraudulent or abusive activity is suspected.
• Close or suspend customer accounts involved in actual or attempted fraud.

2. Order Acceptance & Contract Formation

By completing the checkout process, you make an offer to purchase the products in your cart under these Terms.

• Order acknowledgement: after checkout you will receive an automated email summarizing the items you selected. This email confirms that we received your order but does not constitute our acceptance.
• Order acceptance: a contract is formed only when we mark your order as “Processing” or dispatch the products, whichever occurs first.
• Right to decline: we may cancel or refuse any order (for example, if payment cannot be authorized, if a product is unavailable, or if we identify an error in price or product information). In such cases, any amounts paid will be refunded.

3. Product Availability & Territory

• Products shown on the Facoles website are offered subject to availability.
• We primarily ship to addresses in the United States and selected international destinations as described in our Shipping Policy. We make no representation that our products or content are appropriate for use in every country or region.

4. Pricing, Taxes & Payment

• All prices are listed in U.S. Dollars (USD) and, unless noted otherwise, are exclusive of applicable taxes and shipping fees.
• Prices, promotions, and shipping rates are subject to change at any time without prior notice. Price changes will not affect orders we have already accepted.
• Sales tax is collected in jurisdictions where Facoles has a tax obligation. Applicable tax is calculated based on the shipping destination and current rates at the time of shipment. In locations where we do not collect tax, any required tax may remain your responsibility under local law.
• Payment must be made using the methods shown at checkout. For most physical products, your payment method is charged when your order enters processing or just before shipment. Digital goods or services may be charged at the time of delivery of access.

5. Sales Tax Details (U.S.)

In accordance with state and local regulations, Facoles collects sales tax in U.S. jurisdictions where we have a tax nexus. Collected taxes are remitted to the appropriate tax authorities; we do not profit from these amounts.

Tax shown at checkout is an estimate. The final tax charge is calculated at the time of shipment based on the specific tax rates applicable to the shipping address.

We currently collect sales tax for qualifying orders shipped to states where required by law. If tax is not collected for your jurisdiction, you may still be responsible for reporting and paying any use tax directly to your state or local tax authority.

6. Cancellations, Changes, Shipping & Returns

In summary:

• Orders may typically be modified or canceled within 12 hours of placement. After that time, the order enters processing and can no longer be changed or canceled.
• Products are made‑to‑order. We cannot accept returns for change of mind, incorrect size selection, or minor color variations.
• We do accept returns and replacements for qualifying issues such as damaged, defective, or incorrect items when reported within the specified timeframes.

7. Intellectual Property & Limited License

• All content on the Facoles website—including text, graphics, logos, photos, designs, and code—is owned by Facoles or its licensors and is protected by intellectual property laws.
• We grant you a limited, non‑exclusive, non‑transferable license to access and use the site for personal, non‑commercial purposes only.
• You may not reproduce, modify, distribute, display, or create derivative works from any part of the site or our products without prior written permission from Facoles.
• Any unauthorized use automatically terminates your permission to use the site and may violate applicable laws. You must immediately destroy any downloaded or printed materials obtained in violation of these Terms.

8. User Content, Reviews & Feedback

Facoles appreciates customer feedback and reviews. However, please note:

• By submitting reviews, comments, photos, suggestions, or other content (“User Content”) on our site or social channels, you grant Facoles a worldwide, perpetual, irrevocable, royalty‑free, and transferable license to use, reproduce, adapt, publish, translate, and display such content in any media for marketing, promotional, or operational purposes.
• Do not submit confidential information or creative materials you do not wish to license to us.
• You are responsible for ensuring that your User Content does not infringe any third‑party rights (including copyright, trademark, privacy, or publicity rights) and does not contain unlawful, abusive, or offensive material.
